This privacy policy (the 'Privacy Policy') explains SceneCaster's online information practices, including how SceneCaster uses both personal and non-personal information collected and received at this Site. By using or accessing the Site or by using any of any of the content hosting and sharing services provided by the Site (collectively, the 'Services'), you are confirming that you have read, understand and agree to be bound by Terms of Use and this Privacy Policy, (collectively, the 'Agreement') without limitation or qualification, whether or not you register as a member. Collection of InformationSceneCaster collects information about you when: (i) you use the Site; and (ii) when you voluntarily provide your information to SceneCaster. No personally identifiable information about you, such as your age, name, address, telephone number or e-mail address is collected by SceneCaster when you use the Site except when you provide such personal information on a voluntary basis, such as, but not limited to, when you create an account, provide feedback regarding the Site or otherwise contact SceneCaster.
Use and Disclosure of Information
SceneCaster uses your personal information in order to efficiently operate the Site. In consideration for the use of the Services, you agree that SceneCaster may use your personal information to maintain your account, personalize and improve your online experience, send communications about new services or promotions (including those from third parties), respond to your questions or feedback, notify you of policy changes, conduct research and provide anonymous, aggregated demographic information and reporting for internal and external clients or other partners, and to process credit card transactions. SceneCaster does not provide personal information to third party marketers without your permission.
SceneCaster reserves the right to disclose personally identifiable information: (i) if such disclosure is made pursuant to a legal proceeding or required by law; (ii) if such disclosure is made for the purposes of seeking assistance from law enforcement to protect the interests or safety of SceneCaster, users or other visitors to the Site; (iii) to another entity should SceneCaster plan to merge with, or be acquired by that entity; or (iv) organizations involved in a merger involving SceneCaster or a transfer or sale of SceneCaster's assets. Except as permitted by applicable law, recipients of such personally identifiable information are required to protect such information in a manner that is consistent with this Privacy Policy. Although SceneCaster takes appropriate measures to safeguard against unauthorized disclosures of personal information, SceneCaster cannot assure you that collected information will never be disclosed in a manner that is inconsistent with this Privacy Policy.
Invite or Send to a Friend If you elect to invite a friend to become a SceneCaster member, or if you decide to send a friend an invitation to view your personalized scene (User Content), SceneCaster will ask you for the friend's e-mail address. In either case, SceneCaster will send the friend an e-mail. SceneCaster does not sell these e-mail addresses or use them to send any other communication besides invitations.
Site Tracking Data
Cookies and Web Beacons: SceneCaster uses cookies to collect and store personal information, such as your e-mail address, in order to improve session continuity and repeated Site usability. A 'cookie' is a small file that is saved on your computer's hard drive. Cookies help to give you faster access to pages you have already visited. They also allow you to personalize your pages, and optimize your experience at our Site. SceneCaster also uses cookies to help SceneCaster figure out how many people visit the Site, which of the Site's pages they visit, and how long they stay there in order to determine which of the Site features are highly successful and which may need improvement. You can disable cookies on your computer by indicating this in the preferences or options menus in your browser. Disabling cookies may prevent you from properly accessing the Site or using the Services. SceneCaster may also use 'web beacons' which are tiny image files placed in a web page, and which are counted when served and help monitor how consumers navigate and interact with the Site. Web beacons also help measure the effectiveness of the Site and advertising in various ways, for example, by counting the number of individuals who visit the Site from a particular advertisement.
Session IDs: Session IDs allow SceneCaster to identify a particular user across multiple web page requests. SceneCaster uses Session ID cookies to confirm that users are logged in. This Session ID is maintained within your cookie file, where possible. If cookies are not enabled, or if the user's internet browser program does not support cookies then SceneCaster will place the Session ID in the requested web page. This allows the user to avoid having to continually re-enter certain information such as account name and password for every web page request. The Session ID expires once the user closes their browser.
Web Site Tracking and Reporting: SceneCaster captures data on the type of browser, operating system software and cookie preferences and may use third-party web analytical tools. SceneCaster also records the number of visits, paths taken and time spent on sites and pages within the Site. None of this information is personally identifiable and this information is only distributed to internal staff at SceneCaster and to partners that have signed confidentiality agreements with SceneCaster. All web user data that SceneCaster shares with partners is not personally identifiable and is used only in aggregate form
IP Address: Each time you visit the Site, SceneCaster automatically collects your IP address and the web page from which you came. In order to administer and optimize the Site for you and to diagnose problems with the Site, your IP address is used to help identify you and to gather broad demographic information about you.
Banner Ads: The Services may include the serving and targeting of ads, promotions, or other marketing messages. These ads may be provided by a third party ad service provider. The ad service provider may place or utilize its own unique cookie on your browser, and may use non-personally identifiable information about your visit to the Site, such as the number of times you have viewed an ad. SceneCaster is not responsible for the collection of these cookies and is not responsible for the actions of the ad service providers. Direct URL Linking: : In order to provide more relevant advertising and monitor user bandwidth usage (as governed by the Terms of Use), SceneCaster may gather data identifying where and how frequently user images being hosted by SceneCaster are being displayed on third party sites.
Third Party SitesSceneCaster may place links to other websites operated by third parties (the 'Third-Party Sites') and, from time to time, may include information and links to Third-Party Sites in promotional e-mail. In addition, advertisements may also allow you access to other Third-Party Sites. This Privacy Policy does not apply to any Third-Party Site. SceneCaster has no control over any Third-Party Sites or the content therein or the business practices of any such Third-Party Sites. Consequently, such Third-Party Sites may collect different kinds of information about you, and may use and disclose that information in ways different from SceneCaster. SceneCaster does not assume any responsibility or liability for the actions, products, services and content of linked Third-Party Sites. SceneCaster encourages you to investigate and ask questions before disclosing information to any third party.
Operating Venue
By providing information to SceneCaster, you acknowledge that SceneCaster may operate in the United States of America and agree to permit SceneCaster to, subject to compliance with applicable law, use your information to effect the Services provided by this Site. Such use shall be subject to this Privacy Policy and the Terms of Use.
You understand and agree that SceneCaster may store and process your information on computers which may be located in the United States of America, and by providing any data to SceneCaster, you consent to the transfer of such information to the United States of America.
Security Precautions
SceneCaster has security measures in place to help protect against the loss, misuse and alteration of the information under their control. SceneCaster or its partners uses secure socket layer (SSL) technology to help protect the security of commerce transactions. SceneCaster encrypts your contact information and financial information as it travels over the internet and stores your financial information on servers in encrypted form. Your information may be transferred to and maintained in whole or in part on computer networks which may be located outside of the state, province, country or other governmental jurisdiction in which you reside, and may be stored on equipment or in facilities leased or licensed from third parties. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while SceneCaster strives to protect your personal information and make all commercially reasonable efforts to do so, SceneCaster cannot ensure or warrant the security of any information you transmit to SceneCaster and you do so at your own risk. However, once SceneCaster receives your transmission, SceneCaster makes best efforts to ensure its security on its systems.
This Privacy Policy does not apply to any information, including such photographs, that you submit for use in publicly available areas. You should not submit any personal information, including contact information or financial information, for display in public areas. If you submit such information for display in public areas, SceneCaster cannot prevent it from being used in a manner that violates the law, your personal privacy or your safety. By submitting such information for display in public areas, you assume the risks and sole liability arising as a result of such information being displayed.
SceneCaster shall not be responsible for any damages that result from a lapse in compliance with this Privacy Policy because of a security breach, technical malfunction or similar problem. Always be careful and responsible regarding your personal information.
Changing or Removing InformationAccess and control over personal information on SceneCaster is available through the profile editing tools. Changes to information will be updated immediately. Registered users who wish to deactivate their SceneCaster account may do so by contacting privacyofficer@scenecaster.com. Deleted information may persist in backup copies for a period of time but will not be generally available to other users of the Site.
Children Under Age 13 SceneCaster does not knowingly collect or solicit personal information from anyone under the age of thirteen (13) or knowingly allow such persons to register on the Site. If you are under the age of thirteen (13), please do not send any information about yourself to SceneCaster. In the event that SceneCaster learns that it has collected personal information from a child under the age of thirteen (13), SceneCaster will delete that information immediately. If you believe that we might have any information from or about a child under the age of thirteen (13) using or accessing the Site, please contact SceneCaster at privacyofficer@scenecaster.com.
Changes to Privacy PolicySceneCaster may, in its sole discretion, from time to time and at any time, change, modify or otherwise alter any terms and conditions of this Agreement for any reason. Changes and/or modifications shall become effective immediately upon the posting on the Site. If SceneCaster will use or disclose your personally identifiable information in a manner materially different from that stated at the time your information was collected, you will have a choice as to whether or not SceneCaster may use or disclose your information in this new manner.
